The court has concluded an inquiry into the death of Akshay Shinde, the accused in a sexual assault case, and has found that five police officers are responsible for his death. According to the court, a magistrate conducted an investigation and submitted a report stating that these five officers were to blame for Shinde's death. The court directed that a First Information Report (FIR) be filed against the officers, and an investigation should follow.
The court further stated that the government must file an FIR based on the magistrate's report and clarified that an investigation should be carried out. The judges asked the government to inform them within two weeks about which agency would take over the investigation.
The court also ordered that a copy of the inquiry report be given to the prosecution and Akshay Shinde's family. The original report, along with the documents and witness statements, will be kept by the court for future reference, as the prosecution might need them in the investigation.
Akshay Shinde, 24, was arrested in August 2024 for allegedly sexually assaulting two minor girls inside a school toilet in Badlapur. Shinde worked as an attendant at the school. On September 23, 2024, he died in what the police described as a shootout. The police claimed that while being taken for questioning from Taloja prison, Shinde snatched a gun from one of the officers in the police van, fired it, and was killed in the retaliatory firing. Senior Police Inspector Sanjay Shinde was the officer who shot Akshay, while Assistant Police Inspector Nilesh More, two constables, and a driver were present in the van during the incident.
Shinde was being transported for questioning in connection with a case filed against him by his wife. When an accused person dies in police custody, the law requires a magistrate inquiry, which is what led to this investigation.
Additionally, the High Court had taken action (suo moto) regarding the sexual assault case and instructed the formation of an expert committee to review safety concerns in schools and educational institutions. On Monday, Public Prosecutor Hiten Venegaonkar presented an affidavit from the state education department, which detailed the steps taken after the incident. Venegaonkar mentioned that the committee’s report would be ready by January 31, 2025.
