Mamata Banerjee Seeks Death Penalty For RG Kar Convict, Heads To HC

West Bengal Chief Minister Mamata Banerjee has expressed her disappointment over the court's decision to give life imprisonment instead of the death penalty to Sanjay Roy, who was convicted of raping and murdering a trainee doctor at Kolkata's RG Kar Medical College and Hospital. She made it clear that her government would approach the High Court to seek the death penalty for Roy.

On Monday, after a Kolkata court sentenced Roy to life imprisonment till death, Mamata Banerjee said that the Kolkata Police would have ensured the death penalty if the investigation had stayed with them. However, the case was taken over by the CBI, which she believes affected the outcome.

"We demanded the death penalty from the very beginning, and we still do. But, it's the court's decision. I can share my party's view. We managed to get the death penalty in three cases within just 60 days. If the case had stayed with us, we would have ensured the death penalty long ago. I'm not satisfied with this verdict. Had it been the death penalty, at least I would have felt a bit of peace," Mamata Banerjee said.

She also expressed shock that the court ruled that the crime did not fall under the "rarest of rare cases," a classification that would justify a death sentence. She stated that the case certainly deserved the death penalty, and her government would fight for it at the High Court. "I am convinced this is a rarest of rare cases that deserves capital punishment. How could the court say it's not? We want the death penalty for the convict in this serious case," she wrote on social media.

In her post, Mamata Banerjee pointed out that in the last few months, her government had managed to get the death penalty or the maximum punishment for other criminals in similar cases. She was perplexed as to why Roy's case didn't lead to a similar verdict.

The Additional District and Sessions Judge of the Sealdah court, Anirban Das, delivered the judgment, stating that even though the CBI had requested the death penalty, the defense lawyer argued for a jail term instead. The judge ruled that this crime did not meet the criteria for "rarest of rare" cases and sentenced Roy to life imprisonment. He explained that Roy caused harm during the rape, which led to the death of the victim.

The family of the deceased doctor, who was raped and murdered in a seminar hall at RG Kar Hospital in August last year, expressed shock over the sentence. The doctor’s mother said, "We are shocked. How can this not be the rarest of rare cases? A doctor was raped and murdered while on duty. There was a bigger conspiracy behind this crime."

Doctors who had protested for justice and better security at hospitals also shared similar concerns, mentioning that other people involved in the crime had not been caught. The Federation of Resident Doctors Association (FORDA) India, which was one of the main groups that organized protests, expressed their disappointment on social media, stating, "You can get away with a brutal rape and murder with just life imprisonment in India. What a shame! Highly disappointed. This is not over yet."
Mamata Banerjee's government is now determined to appeal the court's decision in the High Court, hoping for the death penalty for Sanjay Roy.
