The Delhi High Court recently made an important statement about gender neutrality in the justice system. The court said that a fair justice system should not treat people differently based on their gender, especially when it comes to serious crimes that cause harm to others. Justice should be the same for everyone, whether the accused is a man or a woman.
This came after the court dismissed the anticipatory bail request of a woman accused of a very serious crime. She was accused of burning her husband with boiling water mixed with chili powder. The court explained that crimes that cause life-threatening injuries must be dealt with seriously, no matter who the person committing the crime is. A person's gender should not make a difference in how the crime is treated.
Justice Swarana Kanta Sharma, who made this statement, emphasized that when women commit violent acts, the justice system should not give them special treatment just because of their gender. She also pointed out that it is wrong to assume that men cannot be victims of violence in relationships. Men, too, have the right to legal protection, just like women.
The court addressed the idea that men who are victims of violence often face difficulties. These difficulties include not being believed by society and feeling ashamed because of the stereotype that men cannot be hurt in relationships. The court said these stereotypes are wrong and need to be challenged.
The court also rejected the woman’s argument that she should be treated more leniently because she was a woman. It said that treating one gender more leniently in such cases would weaken the principles of justice. The woman’s actions, the court noted, clearly showed an intention to cause serious harm or even death. The court pointed out that if the roles had been reversed, and it was the husband who had poured boiling water on his wife, society would not have shown any mercy toward him.
The court also mentioned that the woman did not cooperate with the investigation and that the husband’s phone had to be recovered. The court concluded that there were no valid reasons to grant her anticipatory bail and refused her request.
This ruling shows the importance of a fair and gender-neutral justice system, ensuring that everyone, regardless of gender, is held equally responsible for their actions.
