The Federal Court of Malaysia has postponed the hearing for Tan Sri Mohd Isa Abdul Samad, former chairman of the Federal Land Development Authority. He is requesting a review of the reinstated corruption conviction, prison sentence, and significant financial penalty. The adjournment follows a defense request for access to official records from previous court proceedings held earlier this year in February.
Chaired by Chief Judge of Malaya Datuk Seri Hashim Hamzah, the three-member bench agreed to grant the defense access to recordings and transcripts from the February 5 and 10 hearings. Justice Hashim emphasized that providing this access serves the interests of justice, addressing discrepancies between both sides regarding earlier courtroom discussions.
During the proceedings, defense lawyer M.M. Athimulan argued that the recordings are vital for evaluating whether the previous panel had invited the defense to present additional arguments regarding mitigation after Isa Samad's conviction. The prosecution countered, claiming the defense had been given such an opportunity, but the defense refuted this assertion, seeking clarification through official records.
The court has scheduled case management for tomorrow while the parties review the transcripts in preparation for the next phase of the case. The bench also included Chief Judge of Sabah and Sarawak Datuk Azizah Nawawi and Federal Court judge Datuk Collin Lawrence Sequerah. The prosecution was represented by Deputy Public Prosecutor Afzainizam Abdul Aziz, with assistance from Mohamad Arif Aizuddin Masrom.
Isa Samad, aged 76, is currently serving a six-year sentence following a Federal Court ruling that reinstated his corruption conviction. The ruling also reinstated a fine of RM15.45 million. He had initially been acquitted by the Court of Appeal in March 2024, a decision which was later overturned by the Federal Court.
This case involves high-profile corruption, linked to Felda Investment Corporation Sdn Bhd’s acquisition of the Merdeka Palace Hotel and Suites in Kuching, Sarawak, for RM160 million. Isa Samad allegedly received over RM3 million in bribes via his former special officer for approving the hotel deal. The High Court had found him guilty of all nine corruption charges back in February 2021.
As one of Malaysia's significant corruption trials involving a senior political figure, Isa Samad’s legal team has filed an application under Rule 137 of the Federal Court Rules 1995, alleging a breach of natural justice in the earlier hearings. The forthcoming review is expected to draw considerable public interest as the legal battle unfolds in Malaysia's highest court.
